Terms

These Terms of Service (the “Terms”) govern the use of the free referral service provided by Schlüsseldienst Notdienst (referred to as “we”, “us” or “the referral service”). We are a pure referral service and do not perform any locksmith work ourselves.

1. Scope

These Terms apply to the referral of jobs between you as the customer and independent, legally separate partner locksmith businesses. The subject of our service is the referral only; the actual work (such as opening a door or replacing a lock) is performed solely by the partner business referred to you and is governed by that business's own terms and prices.

Any conflicting terms of the customer do not apply unless we expressly agree to them in writing.

2. Our Service

Our service consists of receiving your request and referring you to a suitable, vetted partner business near you. As a rule, we name the nearest available partner business so that you can be helped as quickly as possible.

The referral is free of charge for you. No costs arise towards us for the referral itself. We do not guarantee a specific response or arrival time, nor the availability of a partner business at a particular moment, but we make every effort to arrange a prompt referral.

3. Conclusion of Contract

A contract for the performance of the locksmith work is concluded exclusively and directly between you and the independent partner business. We do not become a party to this service or works contract and assume no obligations arising from it.

The contract with the partner business is usually concluded on site, after the partner business has informed you of the price and you place the order. All rights and obligations arising from the performance of the work, in particular warranty and guarantee claims, exist solely towards the partner business.

4. Prices and Payment

We do not set any prices and do not quote a price for the locksmith work. The price is determined exclusively by the respective partner business. The partner business will state the price to you before starting work, so that you can decide whether to proceed before placing the order.

There is no prepayment to us. Payment for the work performed is made directly to the partner business in accordance with its payment terms.

5. Customer Duties

To ensure that the referral and the subsequent work proceed smoothly, you undertake to:

  • provide accurate and complete details when submitting your request, in particular regarding the location, the nature of the problem and how you can be reached;
  • prove, at the partner business's request, that you are authorized to access or open the property or vehicle concerned (for example a home, building or car);
  • be present to receive the partner business on site and to provide access to the location.

6. Liability

Our liability is limited to the correct forwarding of your request and to the careful selection of the partner businesses. We are not liable for the execution, the quality, the pricing or any damage in connection with the work performed by the partner business, as we are not a party to that contract.

For other damages, we are liable only in cases of intent and gross negligence. In the case of slight negligence, we are liable only for the breach of a material contractual obligation (a cardinal duty) whose fulfilment makes the proper performance of the referral possible in the first place and on whose observance you may regularly rely; in such cases liability is limited to the foreseeable damage typical for this type of contract.

Statutory liability for damage resulting from injury to life, body or health, as well as liability under the Product Liability Act, remains unaffected by the above limitations.

7. Right of Withdrawal

If you are a consumer, you have a statutory right of withdrawal in respect of our (free) referral where the contract is concluded off-premises or by means of distance communication. You may withdraw from the referral contract within fourteen days without giving reasons, in text form (for example by e-mail to info@schlusseldienst-notdienst.de). The withdrawal period begins on the day the contract is concluded.

Please note the emergency-service nature of our offering: if you expressly request that the referral, and the work connected to it, begin during the withdrawal period, your right of withdrawal may lapse early pursuant to § 356 of the German Civil Code (BGB) once the service has been fully performed. In such a case we will inform you of the consequences of your express request.

8. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which you have your habitual residence remain unaffected.

Should individual provisions of these Terms be or become wholly or partly invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory rule.
